Lawsuit over web tracking activity resolved by Truist
In a similar turn of events, Canadian bank BMO is facing a lawsuit that alleges the use of trackers collecting user data without consent, much like the recent settlement between John Tasker and Truist.
The lawsuit, filed by California resident John Tasker on May 28, claims that BMO embeds trackers such as pixel trackers, JavaScript snippets, and cookies on its website, covertly collecting and selling user data to third-party advertising platforms. The specific type of information collected, such as internet protocol addresses, click paths, and session time stamps, remains unclear.
Like the case against Truist, the lawsuit alleges that this violates the California Invasion of Privacy Act. However, it's not known if the BMO lawsuit states that data brokers and tech firms collect information to construct detailed consumer profiles, which are then sold to third parties without the user's awareness.
In contrast, the settlement details for the Truist case are not available on the case docket. A spokesperson for Truist did not immediately respond to a request for comment, while a BMO spokesperson and Tasker's attorney also remained unresponsive.
Last week, Truist settled a proposed class-action lawsuit over data privacy violations. The specifics of the settlement between Truist and John Tasker regarding the class-action lawsuit have not been disclosed publicly. While the settlement ends Tasker’s individual claims, broader class-action claims may still proceed.
A separate lawsuit, filed by Tasker against BMO on the same day as the Truist suit, remains active. The outcome of this lawsuit and its impact on BMO's data collection practices will be closely watched.
