Your Rights under the Consumer Rights Act 2015

Within 30 Days

If you purchase faulty or unsatisfactory goods, you have the right to reject them and receive a full refund within 30 days of the purchase.

Up to 6 Months

If you keep the goods beyond 30 days, you can demand a repair or replacement within the first 6 months. The fault is presumed to have been there at purchase, and the retailer generally chooses whether to repair or replace.

After Failed Repair/Replacement

If the repair or replacement fails, you are then entitled to a full or partial refund. After the first 6 months, partial refunds may be given if the goods do not conform after repair or replacement.

Beyond 6 Months

You can make a claim for up to 6 years (5 years in Scotland) after purchase, though proving a fault after 6 months requires evidence that the defect existed at the time of sale.

The Importance of the Warranty Period

The warranty period is a specific time frame after a purchase during which a full refund or repair is guaranteed. However, it's essential to note that a warranty is not a replacement for statutory legal rights when it comes to consumer protection.

High-priced items, such as smartphones costing £1000 or more, are expected to last longer than 14 months, according to Martin Lewis. If a product's lifespan is shorter than expected, considering its price, it may not meet the "reasonable length of time" requirement.

Beyond the Warranty Period

The Consumer Rights Act 2015 does not specify an exact definition for a "reasonable length of time," leaving room for potential grey areas. In case of a dispute, the court ultimately decides on the appropriate length of time for a product's lifespan.

Online Purchases

For goods bought online, faulty items are also eligible for a full refund within 30 days, and repairs or replacements can be requested within 6 months. Retailers must also notify who pays return costs in case of faulty goods.
