Senator Elizabeth Warren, a senior member of the Senate Armed Services Committee, has called on the U.S. Department of Defense (DoD) to ensure fair competition in artificial intelligence (AI) contracting and safeguard data collection amid concerns about potential conflicts of interest.

In a letter to Secretary of Defense Pete Hegseth, Warren expressed concerns about the use of a specific AI chatbot, developed by xAI, in analyzing data within the federal government. According to previous reports, this usage could potentially violate conflict-of-interest laws and put sensitive information at risk.

Warren stated, "I seek to ensure that the DoD's procurement decisions encourage competition and avoid consolidation that can lead to higher prices, concentration of risk, and the stifling of innovation." The senator from Massachusetts requested the Pentagon to outline its AI acquisition practices, strategies to avoid over-reliance on specific contractors, and measures for data security.

Moreover, Warren inquired about the department's plans to avoid using government data for illegally training commercially available AI algorithms. The DoD had not responded to a request for comment at the time of publication.

While the letter did not directly mention the xAI chatbot or its competitors, such as OpenAI's ChatGPT and Anthropic's Claude, the call for increased competition in AI contracting is of great importance.

Recent guidance from the White House's Office of Management and Budget highlights the need for a competitive American AI marketplace, although it exemptedNational security and defense systems from these directives.

Senator Warren and Senator Eric Schmitt, a Republican senator from Missouri who also serves on the Armed Services Committee, have introduced a bill to promote AI competition within the Defense Department. This legislation, known as the Protecting AI and Cloud Competition in Defense Act, focuses on safeguarding government data, promoting competition in AI and cloud computing contracts, and establishing opportunities for smaller vendors.

The DoD's annual budget approaches $1 trillion, accounting for over half of the federal government's contracting dollars in the fiscal year 2023, according to the U.S. Government Accountability Office. By ensuring competitive AI contracting and maintaining data security, the Defense Department can foster innovation while protecting American citizens' sensitive information.
