The Trump administration has announced plans to transform the current H-1B visa lottery system into a merit-based, weighted selection process. This new approach aims to prioritize highly skilled and well-compensated foreign workers, shifting the focus from pure chance to merit as measured by wages and qualifications.

Under the proposed changes, the 85,000 annual H-1B visas, including the 20,000 reserved for U.S. advanced degree holders, would be allocated based on factors such as wage levels, skills, experience, and salary. The new system would rank and select petitions starting with those offering the highest wage levels, descending through lower wage categories based on Occupational Employment Statistics levels.

This shift could potentially disadvantage startups, nonprofits, small businesses, recent graduates, and outsourcing firms that cannot compete with large tech corporations on salaries. It's also likely to reduce the share of visas granted to Indian nationals, who have been the largest beneficiaries under the current system, making up around 70-77% of approved visas.

Critics of the H-1B visa program argue that it allows companies to hire foreign workers at lower wages, potentially displacing American workers. However, supporters of the program, including U.S. tech companies, argue that it is crucial for bringing in skilled foreign workers, particularly from India, to fill crucial roles in the tech industry.

Some users believe that the removal of the lottery system could negatively impact IT consultancies like Cognizant and Infosys. On the other hand, others argue that the new system could potentially lead to an increase in average first-time H-1B salaries, currently around $106,000, to as high as $172,000.

The Department of Homeland Security (DHS) has proposed implementing a "weighted selection process" for applications under the capped portion of the H-1B program. The US Citizenship and Immigration Services (USCIS) will continue overseeing the application process under the proposed change.
