WestLotto Proposes Regulations for Loot Boxes in Video Games

WestLotto, a German lottery company, has published a legislative proposal aimed at regulating loot boxes in video games. The proposal, formulated by lawyer Carsten Bringmann of law firm Noerr, was presented on October 2, 2023, and is set to be discussed at the Federal Congress on Gambling in Berlin.

The new section 14b of the German Youth Protection Act (JuSchG) proposes specific regulations targeting loot boxes to protect minors. Loot boxes, recognized as gambling-like mechanics, can lead to harmful spending behaviors, particularly among children and adolescents.

The proposed rules include strict age verification and access restrictions, mandatory transparency requirements, a prohibition of manipulative commercial practices targeted at minors, and clear labeling in game listings if loot boxes are present. These regulations align with broader European regulatory trends, aiming to safeguard children from exploitation in online gaming environments.

The focus is on reducing exposure to gambling-like mechanics and ensuring consumers, especially minors, are well-informed and protected from compulsive spending risks. The draft also includes technical requirements such as 2-factor authentication and a maximum deposit limit.

WestLotto CEO Christiane Jansen expressed hope that the proposal will be adopted by the legislature. She stated that gambling-like elements in gaming have been a growing problem for children and young people for years.

The speed and form of an amendment to the Youth Protection Act are uncertain at present. However, with the formulated legislative draft, WestLotto has taken another step forward in the regulation of loot boxes. In late August 2023, WestLotto was invited to a webinar to discuss the requirements for regulating loot boxes in the context of gambling.

It is expected that Carsten Bringmann will present the draft at the Congress. The draft includes mandatory information and labeling of loot boxes, aiming to promote transparency and consumer protection. This approach reflects the growing consensus on the necessity to regulate loot boxes as a consumer protection and youth safeguarding measure rather than traditional gambling law alone.
